Faryal Talpur, Khursheed Shah granted bail in NAB cases

Faryal Talpur, Khursheed Shah
PPP leader Faryal Talpur was granted bail by the Islamabad High Court (IHC) on Tuesday, in a case pertaining to money laundering through fake accounts which is being probed by the National Accountability Bureau (NAB).

She was granted bail against surety bonds worth Rs10 million.

During today's hearing, the court asked NAB's additional prosecutor general Jahanzaib Bharwana if the bureau was done interrogating Talpur. Bharwana responded in the affirmative.

In response to the court's inquiry regarding Talpur's involvement in the case, NAB's counsel insisted that money, allegedly transferred to Zardari Group's bank account from a fake bank account, was withdrawn later by a cheque signed by Talpur.

NAB had taken the PPP leader into custody earlier this year to interrogate her in the case. She was kept in Adiala jail.

Talpur had filed a bail application earlier this month, maintaining that she is the mother of a differently-abled child. In order to care for her child, she asked the court to grant bail until the completion of the trail. Her appeal was meant to be heard last week but was adjourned until today as NAB had not submitted a response.

Her brother Asif Ali Zardari was also granted bail by the IHC last week on medical grounds.

Zardari, Talpur, and others accused face charges of corruption through fake bank accounts and embezzlement in the financial facility for Park Lane Private Limited and Parthenon (Pvt) Limited. NAB alleged that the national exchequer suffered a loss of Rs3.77 billion because of the irregularities.

PPP stalwart Khursheed Shah was also released on bail by an accountability court in Sukkur. The court ordered him to pay Rs5m in surety bonds for his release.

Shah was brought to the court via ambulance from the National Institute of Cardiovascular Diseases (NICVD) today after a five-day judicial remand granted to NAB expired.

The PPP leader was arrested by NAB's Sukkur and Rawalpindi teams in September this year and was later shifted to Sukkur.

Multiple corruption cases against him are under investigation with NAB. In 2012, an accountability court had directed NAB to file a reference against him on a complaint pertaining to alleged accumulation of illegitimate assets.

In 2013, NAB had reopened two corruption cases against Shah under the directives of the Lahore High Court.

In July this year, NAB Chairman retired justice Javed Iqbal had approved nine inquiries against different personalities, including Shah.

Armed forces in 'pain and anguish' over Musharraf verdict: ISPR

General (r) Pervez Musharraf
The Pakistan Army on Tuesday said that it was in "a lot of pain and anguish" over the sentencing to death of former military dictator General (r) Pervez Musharraf in the high treason case.

"An ex-army chief, Chairman Joint Chiefs of Staff Committee (CJCSC) and President of Pakistan, who has served the country for over 40 years, fought wars for the defence of the country can surely never be a traitor," the military's public relations wing said in a statement.

It said that the due legal process seemed to have been ignored including the constitution of a special court, denial of fundamental right of self-defence, undertaking individual specific proceedings and concluding the case in haste.

"Armed forces of Pakistan expect that justice will be dispensed in line with the Constitution in the Islamic Republic of Pakistan," read the statement.

The reaction from the military spokesperson comes after a special court handed the death punishment to the former military dictator for abrogating the constitution and imposing a state of emergency on November 3, 2007.

Fall of Dhaka, APS massacre major lessons for state: CJP

Chief Justice of Pakistan (CJP) Asif Saeed Khosa
Chief Justice of Pakistan (CJP) Asif Saeed Khosa on Monday said that December 16 has some lessons for the state as it reminds the country of two tragedies – the fall of Dhaka and the Army Public School (APS) massacre.

Justice Khosa in his address to the National Police Academy in Islamabad talked about the incidents that compelled the state to introduce major changes in its policy.

“Both these tragic events have some lessons for us,” the CJP said.

The CJP highlighted that APS tragedy shook the whole country and led the nation to look into the approaches that were being used by the state.

“That [APS massacre] was the incident we realised enough is enough,” said CJP Khosa, adding that the massacre also led to the formulation of National Action Plan against terrorism.

The CJP said another lesson was that when the country gets together on a single agenda then it can achieve anything.

The top judge said that there was a need for the country to once again look for the areas that unite the country and work on those areas.

On the fall of Dhaka, the CJP said, “if the state starts asserting itself too much then people breakaway from the social contract.”

The top judge told the police officers that this is what they have to teach to the under training officers.

“Time has come to rethink the approach of the police. Police should be perceived as a protector,” remarked Justice Khosa.

The CJP also spoke about the reforms required to change the police and the reforms undertaken by the police reforms committee.

SC issues detailed verdict on army chief's extension

COAS General Qamar Javed Bajwa
The Supreme Court on Monday issued its detailed verdict on the extension of the chief of the army staff.

On November 28, the top court, in its short order, had allowed the federal government to grant a six-month extension to COAS General Qamar Javed Bajwa.

In the detailed verdict penned by Justice Mansoor Ali Shah and issued today, the court states that SC bench "explored the scope of Article 243 of the Constitution, reviewed the Pakistan Army Act, 1952, the Pakistan Army Act Rules, 1954".

The court "found that the Pakistan Army Act, 1952 falls deficient of the structural requirements for raising and maintaining an Army under clause (3) of Article 243 of the Constitution".

The verdict noted that "no tenure or age of retirement for the rank of General is provided under the law. As per the institutional practice a General retires on completion of a tenure of three years. Although an institutional practice cannot be a valid substitute of the law."

"There is no provision in the law for extending service of a General for another tenure; nor is there any consistent and continuous institutional practice of granting such extension," Justice Shah wrote, adding that the summaries for the reappointment, extension and fresh appointment of General Bajwa were "meaningless" in absence of the relevant law.

The verdict further stated that in the light of the attorney general's assurances as well as the importance of the responsibilities of the COAS, it is appropriate that the incumbent COAS may continue for a period of six months.

However, the court warns that in the absence of legislation on the matter within six months, the institutional practice of retirement of a General on completion of the tenure of three years "shall stand enforced".

Chief Justice of Pakistan Asif Saeed Khosa, in his additional note in the verdict, said that "in our peculiar historical context Chief of the Army Staff holds a powerful position in ways more than one," adding that "unbridled power or position, like unstructured discretion, is dangerous."

The chief justice further said that "it has been a shocking revelation to us that the terms and conditions of service of Chief of the Army Staff, the tenure of his office, extension in the tenure of his office or his reappointment have remained unregulated by any law so far."

Justice Khosa, ended his note by saying that "the democratic maturity of our nation has reached a stage where this Court can proclaim that, as declared by Chief Justice Sir Edward Coke of England in the Commendam case in the year 1616 regarding the powers of King James I, “Howsoever high you may be; the law is above you”.
